  • Domains may be locked to prevent unauthorized transfers.

6. Domain Use Restrictions

  • Domains may not be used for illegal, fraudulent, or malicious activities.
  • Registrants must comply with all applicable laws and registry-specific usage policies.

7. WHOIS and Privacy

  • Registrant information is submitted to WHOIS databases as required by ICANN and registries.
  • WHOIS privacy services may be available to mask personal data, subject to separate terms.

8. Suspension and Cancellation

  • Finixhost reserves the right to suspend or cancel domains for violation of this agreement, non-payment, or upon registry request.
  • Domains suspended or cancelled may become unavailable and irrecoverable.

9. Refunds and Cancellations

  • Domain registrations are generally non-refundable once processed unless otherwise specified in our refund policy.
  • Cancellation requests must be submitted prior to domain activation or renewal.

10. Intellectual Property and Disputes

  • Registrants must respect third-party trademarks and intellectual property rights.
  • Domain disputes will be handled through the Uniform Domain Name Dispute Resolution Policy (UDRP) or applicable local dispute resolution procedures.

11. Limitation of Liability

  • Finixhost is not liable for any loss or damages arising from domain registration, suspension, or deletion.

12. Governing Law

  • This agreement is governed by the laws applicable to Finixhost’s jurisdiction.

1. WHOIS Privacy Service Agreement

This WHOIS Privacy Service Agreement (“Agreement”) governs the use of the WHOIS Privacy Service (“Service”) provided by Finixhost.com (“Finixhost,” “we,” or “us”) to protect the personal information of domain name registrants (“You” or “Registrant”).

By subscribing to or using the WHOIS Privacy Service, you agree to be bound by the terms set forth in this Agreement.

1.1. Purpose of the Service

  • The WHOIS Privacy Service is designed to protect your personal contact information associated with domain registration from public disclosure in the WHOIS database.
  • Instead of your personal details, proxy contact information provided by Finixhost or its partners will appear in the WHOIS records.

1.2. Scope of the Service

  • The Service masks the registrant’s name, address, email, and phone number in the public WHOIS database.
  • Finixhost acts as the proxy contact for your domain during the term of the privacy service.

1.3. Registrant Responsibilities

  • You must provide accurate and complete registration data to Finixhost.
  • You agree to keep your contact information up to date in Finixhost’s records.
  • You acknowledge that certain information may still be disclosed by Finixhost as required by law, ICANN policies, or third-party registrar agreements.

1.4. Limitations and Exclusions

  • The WHOIS Privacy Service does not guarantee complete anonymity. Finixhost may disclose your information in response to lawful requests such as court orders, subpoenas, or governmental inquiries.
  • The Service does not protect against spam or unsolicited communications sent to the proxy contact.
  • The privacy service is only applicable to domains where privacy is permitted by the relevant registry or registrar policies.

1.5. Service Fees and Term

  • WHOIS Privacy Service fees are billed separately or as part of the domain registration package.
  • The Service is renewable annually or as per the domain registration term.

1.6. Termination

  • You may cancel the WHOIS Privacy Service at any time; upon cancellation, your personal data will be restored in the public WHOIS database.
  • Finixhost reserves the right to terminate or suspend the Service if you violate this Agreement or if the domain registration is cancelled or transferred.

1.7. Disclaimer and Liability

  • Finixhost provides the Service “as-is” and disclaims all warranties regarding its effectiveness.
  • We are not liable for any damages resulting from disclosure of your personal information, whether by legal compulsion or unauthorized access.

1.8. Governing Law

  • This Agreement shall be governed by the laws applicable to Finixhost’s principal place of business.

2. Supplemental Registry Agreement for Certain TLDs

Certain Top-Level Domains (TLDs) offered by Finixhost.com are subject to additional registry-specific terms and conditions mandated by the respective domain registries. By registering, renewing, transferring, or managing a domain under these TLDs through Finixhost, you agree to comply with the supplemental registry agreements applicable to those TLDs.

2.1. Scope of Supplemental Agreements

  • These supplemental agreements may impose additional obligations on registrants, including but not limited to data accuracy, eligibility, dispute resolution, and acceptable use.
  • Finixhost will make reasonable efforts to inform you of any such supplemental terms applicable to your domain registration.

2.2. Examples of Affected TLDs

  • Examples include, but are not limited to, country-code TLDs such as .ca (Canada), .uk (United Kingdom), .de (Germany), and sponsored TLDs like .app, .tech, .ngo, etc.
  • Each registry may have distinct requirements such as residency, business presence, or verification processes.

2.3. Registrant Responsibilities

  • You must review and comply with all supplemental registry terms associated with your domain(s).
  • Non-compliance may result in suspension, cancellation, or transfer restrictions imposed by the registry or Finixhost.

2.4. Registry Policies and Enforcement

  • Registry operators enforce their agreements and policies independently.
  • Finixhost acts as a registrar and intermediary but is not liable for registry enforcement actions.
  • Registries may impose penalties, including domain suspension or deletion, for violations of their supplemental agreements.

2.5. Changes to Supplemental Agreements

  • Registry agreements and policies may be updated by the registry operators from time to time.
  • Finixhost will notify registrants of material changes affecting their domains where possible, but you are responsible for monitoring compliance.

2.6. Dispute Resolution

  • Supplemental agreements often include specific dispute resolution procedures, such as Uniform Domain-Name Dispute-Resolution Policy (UDRP) or country-specific dispute mechanisms.
  • You agree to abide by such procedures in case of disputes regarding your domain.

3 Registration Data Access Protocol (RDAP) Terms of Service Agreement

This Registration Data Access Protocol (“RDAP”) Terms of Service Agreement (“Agreement”) governs your access to, and use of the registration data provided by Finixhost.com (“Finixhost,” “we,” or “us”) via RDAP services.

By accessing or using Finixhost’s RDAP services, you agree to comply with and be bound by this Agreement.

3.1. Purpose and Scope

  • RDAP provides standardized access to domain name registration data managed or provided by Finixhost.
  • This Agreement applies to any person or entity using Finixhost’s RDAP service to query domain registration information.

3.2. Authorized Use

  • You agree to use RDAP data solely for lawful purposes, including network management, security, and compliance.
  • You shall not use RDAP data for unsolicited marketing, spamming, or any activity that violates privacy laws or Finixhost policies.

3.3. Access and Security

  • You must not attempt to circumvent or compromise RDAP service security.
  • Any automated querying of RDAP data must comply with Finixhost’s rate limits and access restrictions.
  • Finixhost reserves the right to suspend or terminate access for misuse or excessive querying.

3.4. Data Accuracy and Updates

  • RDAP data is provided “as-is” and may contain inaccuracies.
  • Finixhost does not guarantee the completeness or accuracy of registration data.
  • Updates to RDAP data occur in accordance with domain registration policies and timelines.

3.5. Privacy and Confidentiality

  • You agree to respect privacy and confidentiality obligations related to registration data.
  • Use or disclosure of personal data obtained via RDAP must comply with applicable data protection laws, including GDPR.

3.6. Limitation of Liability

  • Finixhost disclaims all warranties regarding RDAP service availability and data accuracy.
  • To the maximum extent permitted by law, Finixhost is not liable for any direct, indirect, incidental, or consequential damages arising from RDAP use.

3.7. Termination

  • Finixhost may suspend or terminate your RDAP access at any time, with or without cause.
  • Termination does not affect accrued rights or liabilities.

3.8. Governing Law and Jurisdiction

  • This Agreement is governed by the laws applicable to Finixhost’s principal place of business.
  • Any disputes shall be resolved in accordance with the dispute resolution provisions in the main Terms of Service.

3.9. Penalties for Unauthorized Use

  1. Suspension or Termination of Access
    Finixhost reserves the right to immediately suspend or permanently terminate your access to RDAP services if you are found to be using the data in violation of this Agreement, including unauthorized or abusive usage.
  2. Legal Action
    Unauthorized use of RDAP data, including but not limited to data harvesting, spamming, data resale, or use for unlawful purposes, may result in civil or criminal legal action against the offending party. Finixhost will cooperate with law enforcement and regulatory authorities in any investigations.
  3. Financial Liability
    Users found responsible for unauthorized use may be liable for damages, including direct and indirect losses, fines, and costs incurred by Finixhost due to such misuse.
  4. Bans and Blacklisting
    Repeated or severe violations may result in permanent blacklisting from all Finixhost services and networks.
  5. Indemnification
    You agree to indemnify and hold Finixhost harmless from any claims, damages, losses, liabilities, and expenses arising from your unauthorized use of RDAP data.

3.10. Reporting Unauthorized Activity

If you suspect or become aware of any unauthorized, abusive, or suspicious activity related to the use of Finixhost’s RDAP services or other Finixhost offerings, please follow the procedure below to report it promptly:

1. Initial Report

  • Submit a detailed report to Finixhost’s Security or Abuse Department via email at abuse@finixhost.com or through the designated abuse reporting form on our website.
  • Your report should include:
  • Description of the unauthorized activity or behaviour
  • Date(s) and time(s) of the incident(s)
  • IP addresses, domain names, or account information involved.
  • Any relevant logs, screenshots, or evidence
  • Your contact information for follow-up

2. Acknowledgment

  • Upon receipt, Finixhost will acknowledge your report within 48 hours, confirming that the issue is under review.

3. Investigation

  • Finixhost’s security and abuse team will conduct a thorough investigation to verify the report and assess the impact.
  • During this period, Finixhost may request additional information from you if needed.

4. Action

  • Based on investigation findings, Finixhost may take appropriate actions including:
  • Warning or notifying the offending party.
  • Temporary suspension or termination of service or RDAP access
  • Reporting to law enforcement or regulatory authorities if applicable
  • Follow-up
  • Finixhost will provide updates to the reporting party on the status and outcome of the investigation where appropriate, while respecting confidentiality and privacy considerations.
  • Confidentiality
  • All reports will be treated confidentially to the extent possible, and retaliation against reporters is strictly prohibited.

3.11. What to Include in Your Reporting Email

  1. Subject Line:
    Clear and concise, e.g., “Report of Unauthorized RDAP Activity” or “Suspicious Domain Registration Data Access”
  2. Your Contact Information:
  • Full name
  • Company/Organization (if applicable)
  • Email address
  • Phone number (optional but helpful)
  1. Description of the Issue:
  • Detailed explanation of the suspicious or unauthorized activity observed.
  • Why you believe it is unauthorized or abusive.
  1. Date and Time:
  • When the incident(s) occurred (date and approximate time)
  1. Involved Parties:
  • IP addresses, domain names, usernames, or account IDs related to the activity.
  1. Evidence:
  • Attach relevant logs, screenshots, or other supporting documents.
  • Include URLs or copies of offending content if applicable.
  1. Actions Taken (if any):
  • Any steps you’ve already taken to mitigate or investigate the issue.
  1. Additional Information:
  • Any other details that could help in investigation (e.g., frequency, patterns, related incidents)

3.12. Valid Evidence for Reporting Unauthorized Activity

  1. Server or Application Logs
  • Logs showing suspicious IP addresses, timestamps, error messages, or unusual access patterns.
  1. Screenshots
  • Clear screenshots of error messages, unauthorized content, suspicious behaviour on control panels, or domain records.
  1. Network Traffic Data
  • Packet captures or network monitoring data indicating unauthorized requests or attacks.
  1. Email Headers and Content
  • For spam or phishing complaints, the original email with full headers and content.
  1. URLs or Domain Names
  • Specific web addresses involved in the unauthorized activity or phishing attempts.
  1. Account Information
  • Usernames, account IDs, or other identifiers linked to the suspicious activity.
  1. Timestamped Records
  • Precise date and time information showing when the activity occurred.
  1. Witness Statements or Correspondence
  • Any relevant communication or reports from users or admins involved.

4 Uniform Domain Name Dispute Resolution Policy (UDRP)

4.1. Overview

Finixhost.com complies with the Uniform Domain Name Dispute Resolution Policy (“UDRP”) established by the Internet Corporation for Assigned Names and Numbers (ICANN). The UDRP provides a standardized process for resolving disputes regarding domain name registrations.

4.2. Scope

This policy applies to all domain names registered through Finixhost.com under generic top-level domains (gTLDs) and certain country-code top-level domains (ccTLDs) that have adopted UDRP procedures.

4.3. Filing a Dispute

  • Any third party (“Complainant”) who believes that a domain name registered with Finixhost.com infringes on their trademark or legal rights may initiate a dispute by filing a complaint with an approved dispute resolution service provider under the UDRP, such as the World Intellectual Property Organization (WIPO).
  • The Complainant must demonstrate that:
    • The domain name is identical or confusingly similar to a trademark or service mark in which the Complainant has rights.
    • The Registrant has no legitimate interests or rights in the domain name.
    • The domain name has been registered and is being used in bad faith.

4.4. Registrant’s Obligations

  • Registrants agree to cooperate with Finixhost.com and the dispute resolution provider during the dispute process.
  • Registrants must respond promptly to any complaints or proceedings initiated under the UDRP.
  • Finixhost.com will not adjudicate disputes but will comply with the final decision of the dispute resolution provider.

4.5. Finixhost’s Role

  • Finixhost.com acts as the registrar and will implement the final decision made by the dispute resolution provider, which may include transferring, canceling, or suspending the disputed domain name.
  • Finixhost.com is not a party to any dispute and will not be responsible for determining the outcome of any UDRP case.

4.6. Consequences of Non-Compliance

  • Failure by the Registrant to respond or comply with UDRP decisions may result in the automatic transfer or cancellation of the domain name.

4.7. Fees

  • All fees associated with filing or defending a UDRP complaint are the responsibility of the parties involved and are not covered by Finixhost.com.

4.8. Additional Legal Remedies

  • The UDRP does not prevent parties from pursuing other legal remedies in court.
